This Agreement contains those terms and conditions, what are applicable while using the promotional games (henceforth Service) on the sites of winive.com and partners. Using the Service, You (henceforth Sponsor) sign an agreement with Winive Ltd. (henceforth Winive), and accept the rules and regulations of Winive when using www.winive.com and our partner sites. Winive Ltd. keeps the right to modify this agreement unilaterally.
Sites operated by Winive are available to those, who declare and guarantee, that (i) all information given by the Sponsor to Winive is right and actual; (ii) have the necessary rights to empower, and they empower Winive to run, store on their servers, save to their drives, redirect, and copy, modify, spread, reproduce, publish, display and broadcast their promotional games.
If Winive gets knowledge about that the information submitted by the Sponsor (also) contains false elements, has the right to restrict or even lock or erase the access of the Sponsor submitting the false data.
- Price of registration: 50 USD
- Starting a promotional game: 10 USD/game
The price of registration is to be paid when starting the first promotional game. Payments are evaluated through PayPal.
All prices and fees mentioned in this Agreement are without VAT. All other additional cost is paid by the Sponsor (including VAT, if applicable, and other taxes and fees as well). If not stated otherwise, an invoice will not be issued. Winive can change its fees at any time. Calculating the fees is only based on data recorded by Winive. Winive gives the Sponsor a password protected access to a non-stop online information system. Using it, the Sponsor is able to monitor his/her promotional games.
Starting of promotional games; uploading of products, services; commenting user ratings.
3/1. Starting promotional games or uploading products and/or services on the promotional game sites of Winive Ltd. is only accessible for registered Sponsors.
3/2. The Sponsor is liable for giving accurately and realistically the parameters and properties of the product or service uploaded by him/her.
3/3. The Sponsor, by starting a promotional game, takes obligation to give the service or product to the winner in a condition as previously stated, after the game ends.
3/5. The promotional games of the Sponsor uploaded to the sites of Winive, are counted as agreements, so it is not possible to desist from them.
3/6. A Sponsor can not participate in a promotional game started by him/herself, nor through representatives, or by hiding him/herself behind an other Winive user's account, nor as acting as his/her own representative. An account of such a Sponsor will be immediately erased together with the other users account.
3/8. It is only possible to start to advertise a promotional game, in a category what is most similar to the product's character to be advertised.
3/9. When advertising a promotional game, it is not permitted to display so called keywords. Identical promotional games, auctions containing keywords are removed by Winive. Sponsors starting series of promotional games in the non appropriate category, displaying keywords or advertising identical products more than once, will be banned from their accounts.
3/10. Only real, existing product or service can be advertised in a promotional game!
4/1. In the Hotel category, the prize includes accommodation and reservation costs. The prize doesn't include the cost of optional services (meals, minibar, swimming pool, sauna, phone etc.) and tourist tax.
4/2. In the restaurant category, the prize includes the cost of certain food/beverages in a restaurant.
4/3. In the ticket category, the prize is the ticket for the event announced in the promotional game.
4/4. In the product category, the prize is the product announced in the game.
4/5. Flight ticket category:
A ticket for 2 (two) persons, (so one ticket for the Winner and one more ticket for the person attending him/her, using the tickets together and in one time) bounded by the terms and conditions described in point (b/i) (open ticket).
(a) The voucher will be delivered to the Winner's given delivery address by the Sponsor via postal service.
(b) The ticket will be issued based on the voucher in the customer service office operated by the Sponsor, after receiving the voucher, and proving identity under the following terms:
(i) The ticket is valid for scheduled flights announced in the game and operated by the Sponsor.
(ii) The issued tickets can not be modified or changed and are valid for economy class. Depending on the seat occupation on the plane, they authorize seat reservation for the user.
(iii) The prize includes airport taxes, dues and reservation fees. The prize does not include the cost of optional services (priority check in, luggage fees) and other costs connected to the journey (insurance, visa).
You can track the seat occupation of your flight and can get information about fees and costs on the web site of the Sponsor.
(iv) The terms and conditions of using the ticket are the following:
Delivering the voucher: in 1 month after the game starts.
Ticket issuing: in 2 months after the game starts.
Traveling deadline: in 6 months after the game starts.
Missing the deadline results in the loss of right to travel.
Flight type: one-way/return
Applicability: only for scheduled flights operated by the Sponsor, announced in the game. The attendant and the Winner can only travel together, in the same time. The attendant can not travel alone. If the Winner can not travel, the attendant is not authorized to use the ticket. If the Winner decides to travel alone, can only use one flight ticket (so can not use the attendant's ticket to travel to another destination). The Winner has to designate his/her attendant latest until the ticket is issued.
Seat reservation: must be confirmed, waiting list is not acceptable.
Child/infant allowance: not included
Change: not permitted.
Reimbursement: not permitted.
Open jaw: not permitted
After the promotional game ends, the system automatically sends an e-mail to the Sponsor. This e-mail must be verified by the Sponsor to Winive. This process continuously repeats in 2 days until the verification is received. If the Sponsor does not send the verification in 10 days after finishing the game, the account will be suspended. Verification can be completed through the administrative interface of the Sponsor as well, by clicking on the 'Confirm' button.
For prizes in categories like hotel and restaurant, reception of the winnings is done personally at a site designated by the Sponsor. The cost of reception (travel cost to the Sponsor's site) is to be paid by the Winner.
The delivery of prizes in the Tickets and Products category is operated by postal service. The cost of posting the goods is bore by the Sponsor, but the Winner pays for any additional cost. The risks of transport are bore by the Sponsor. Digital products can be transported to the Winner via email or file sharing. The Sponsor has to inform the Winner about the method of transport.
The delivery of vouchers is operated by postal service.
Sites operated by Winive Ltd. are only supply an interface for information exchange between prize and service suppliers and clients. Exchange of winnings is independent from Winive Ltd. For that reason Winive Ltd. can not hold responsibility for the advertised products, as can not check the quality, harmfulness and legality of them. We are not responsible for the advertised products existence or for that the exchange of goods finally happens or not. As we are not part of the winning's exchange between the Sponsors and Winners, you relieve Winive Ltd. from any kind of claim, compensation or demand if any kind of argument occurs.
The following products and services are forbidden to promote on the sites operated by Winive Ltd.:
- alcohol,
- credit or debit cards,
- unfilled testimonials, warrants, clearances, tickets, passes,
- medicines,
- drugs,
- guns, ammo, explosives, pyrotechnical materials (fireworks), and goods extremely dangerous for public safety, including weapons not restricted by the carrying of arms license (air rifles, air guns, batons, shockers etc.).
- flammable materials,
- explosives, pyrotechnical tools,
- human organ,
- holiday check,
- stolen or illegally released products.
- invitations for community sites, e-mail services,
- user IDs, including Winive IDs as well,
- sexual services,
- pornographic material,
- fakes, products with fake brand names or origin (clothes, watches, etc.),
- and any object, what is able to increase hatred or distract the feelings of others. Such an object can be any object what Winive Ltd. regards so.
The users of Winive give feedback from each other. Please form your feedbacks wisely, because they will be available for all users of Winive and can not be changed afterwards. If you give a feedback what is unrealistically hazards the good reputation of others, then you have to take the responsibility for it, even in case of litigation. Winive can not hold any responsibility for the content of feedbacks submitted by users.
Winive Ltd. reserves the right to ban any user or to delete any information or transaction, what is against the rules of the adequate use of the site.
The Agreement stays in effect until You or Winive terminates it under the following circumstances:
If you want to terminate your agreement with winive, then you can (a) send a letter or e-mail, to ask the termination of the agreement and (b) the termination of all accounts used by you.
Winive can terminate the Agreement at any time, if:
(A) You violate any regulations controlled by the Agreement (or it is obvious that you can not comply with the Agreement's rules); or
(B) Winive has to do so (because the service for you for example is, or becomes malfeasance); or
(C) Winive realizes, that it is not worth to provide services to you.
Your personality rights are extremely important to us, so Winive Ltd. does not give your information to any third party or organization.
We only use your data to identify you and to give you information about the continuous development of our marketing services, to regularly expand our offers, and to create our sites and service's content and look more user friendly. You accept that by registering, we can send you newsletters to your submitted e-mail address, but you can of course cancel this service any time by sending an e-mail to our customer service.
If there are any debates, arguments, we can use your data submitted to clarify the issues. During registration you can revise and change your personal information. If you change your data, we store both versions in our database. Winive, according to the act about personal information protection, can in some cases give information about the registered users, if the national or international authorities ask for it in a formal way.
This Agreement is to be interpreted according to the Hungarian law, and it is governed by the Hungarian law. Parties agree, that if there is any claim or issue, they subject themselves only to the competence of the Hungarian court, without taking into consideration any other regulations of law.
